BOYES SUTTON & PERRY SOLICITORS PRICE INFORMATION (FEBRUARY 2024)
 
We are required by the Solicitors Regulation Authority to publish certain price and service information in relation to specified Probate and Property services that we undertake. To comply with this requirement we set out below our typical charges.
NON-CONTENTIOUS PROBATE FEES.
 
We have a range of charges for non-contentious probate work and the charges depend on the service required. 
 
Should you just require us to prepare the papers that will lead to the Grant of Representation in the estate of a deceased person we have a set fee of £1,650 + VAT and disbursements where a short Inland Revenue account is required.  
 
For the complete administration of a deceased person’s estate we charge by the hour and the charges are calculated on the time spent on the matter together with the number of letters sent and received. Time in meetings, on the telephone and preparing documents is charged at our current hourly rate of £275 + VAT. Letters out are currently charged at £27.50 + VAT (one tenth of the hourly rate) and letters in are currently charged at £13.75 + VAT (one twentieth of the hourly rate).
 
At the beginning of an administration we will consider all aspects of the estate and give an estimate of the likely costs for the administration. An average estate usually involves the equivalent of 20 to 25 hours work which equates to £5,500 to £6,875 + VAT and disbursements. 
 
The fees for the full administration of an estate include obtaining values of the assets and debts in the estate, preparing the papers that will lead to the Grant of Representation in the estate, applying for the Grant of Representation, calling in the assets in the estate, paying debts, tax and legacies, seeking clearance from the Inland Revenue (where required), advertising for creditors, preparing estate accounts and distributing the estate to the beneficiaries.
 
If a Deed of Variation, a sale of a property comprised in the estate or Income Tax returns are required in the estate there will be additional charges and a quotation for the additional charges will be given at the relevant time. 
 
Please note that the estimate given is for an average sized estate. Estates that are smaller will require less time to administer and estates that are greater or more complex (for example estates that include trusts, lifetime gifts and foreign property) are likely to involve more time and an appropriate quotation will be given when the size and complexity of the estate is established at the outset.

RESIDENTIAL CONVEYANCING FEES
 
We are required by the Solicitors Regulation Authority to publish price and service information in relation to residential conveyancing work we carry out. To comply with this requirement we set out our typical charges at the end of this introductory section of our data. 
 
No two transactions are the same and therefore in order to obtain a personalised quote for your transaction, please contact us. 
 
Our professional charges are based on the value of the transaction. 
 
We offer a combined discounted fee when dealing with more than one transaction at the same time. 
 
We normally charge a supplement when dealing with shared ownership property or when dealing with a ‘new build’ property. 
 
Same day bank transfer charges are £30 plus VAT per transfer.
Scope of work – a typical sale transaction
 
The work will consist of: 
 
(a) preparing a sale contract
(b) showing good title to the property which you are selling 
(c) assisting you with replies to the buyer’s enquiries 
(d) liaising with your landlord/managing agent (if applicable) 
(e) negotiating a sale and/or purchase contract
(f) negotiating a transfer document
(g) proceeding to exchange of contracts and then completion of the sale
(h) receiving the sale proceeds
(i) arranging repayment of any mortgage secured against the property which you are selling;and 
(j) accounting to you.
 
 
Scope of work – a typical purchase transaction
 
The work will consist of: 
(a) investigating the title to the property which you are buying, to include 
(i) carrying out searches with respect to title and local government information for the property 
(ii) reviewing replies given by the seller to pre-contract enquiries 
(b) negotiating a sale and/or purchase contract 
(c) negotiating a transfer document 
(d) preparing a report on title 
(e) proceeding to exchange of contracts and then completion of the purchase 
(f) transferring funds by telegraphic transfer to the seller’s solicitors and for relevant taxes 
(g) calculating stamp duty land tax (SDLT) on the purchase and preparing and submitting to HM Revenue & Customs the appropriate SDLT forms and 
(h) registering the purchase and any mortgage at the Land Registry. Please note that the preparation of a declaration of trust (if required) to document an unequal contribution towards the purchase price would be classed as additional work.
 
 
 
Extra charges 
 
Where additional work is required we normally charge an additional fee based on our current hourly rate of £250 plus VAT.
 
 
 
General notes
 
The Land Registry fees to register a purchase or a mortgage are not subject to VAT. Sundry fees that form part of our investigation of title work are subject to the addition of VAT when they are included within your bill.
 
Please note that additional expenses are likely to be payable in the event your transaction is being made via a limited company or other corporate structure. 
 
If it becomes apparent that there are unforeseen circumstances in connection with your transaction we may have to increase our charges, but if that is the case, we shall inform you before we incur any additional costs. 
 
If, for any reason, we have to abort your transaction, we will usually charge for the work actually done at the hourly rate of £275 plus VAT but will not exceed the estimate provided to you, unless we have warned you in advance.
